Dear Mr. Kalmus:
On the occasion of a legal controversy with Associated Music Publishers, New York, Mr. Voigt, their representative assured my lawyer, that Universal had neglected to take a copyright for the score and the parts of Verklärte Nacht. The publisher of the Sextett-Edition has also never applied for a copyright. Accordinf[!] the work is public property.
This gives me an opportunity to carry out a plan, which I have in mind for many years: to make an improved edition of this work and accommodate it in a more practical way to the necesseties of the orchestras.
I therefore accept with pleasure your offer to publish a new edition and I am ready to give you the manuscript of this new edition under the following condition:
As I do not possess any knowledge of the situation which has been created through the war and the impossibility of delivering music from Germany: and as I further am unable to figure out how the legal rights of the composer and the publisher will be changed after this war, I want you to be obliged to make with Universal Edition as soon as the situation has been cleared such an arrangement, that all their legal claims and rights are satisfied.
